These Terms of Service (“Terms”) are a binding agreement between you and Decorators United (“we”, “us”) covering your use of the Decorators United Hat Visualizer, its website, documents, exports and related services (the “Service”). By using the Service, uploading artwork, or buying a plan, you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you agree on its behalf and confirm you have authority to do so. If you do not agree, do not use the Service.
2. The service
The Service lets you place artwork or text on images of blank headwear to create visual mockups, documents (such as work orders, proofs and quotes for your own clients) and requests for a quote from us. Mockups are generated in your browser. We may change, suspend or discontinue features at any time. Some features require a paid plan.
3. Plans, billing & licences
Subscriptions. Paid plans are billed in advance, monthly or yearly, through our payment provider and renew automatically until cancelled. You can cancel at any time; access continues to the end of the paid period.
Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
Price changes. We may change plan prices with at least 30 days’ notice; changes apply from your next renewal.
Licence keys. Your licence key is for the number of seats you bought. Do not share, resell or publish it. We may deactivate keys that are shared, used beyond their seats, or tied to a cancelled, refunded or charged-back payment.
Team plans are priced per seat under a separate order or invoice, which controls if it conflicts with these Terms.
Taxes. Prices exclude taxes unless stated; you are responsible for applicable taxes.
4. Your artwork
You keep ownership of the logos, images and text you upload or type (“Your Content”). Your Content is processed in your browser and stored on your device unless you choose to send it to us (for example with a quote request) or brand screening is enabled (section 7). You grant us a non-exclusive, worldwide, royalty-free licence to host, process, reproduce and display Your Content only as needed to provide the Service, prepare quotes, proofs and products you request, and comply with law. We do not use Your Content to advertise without your permission.
5. Rights you confirm
Each time you upload or type artwork, and again when you send a design to us, you represent and warrant that:
you own Your Content, or have a valid written licence or permission from the owner to use it for mockups and, if you order products, for reproduction on products;
Your Content does not infringe or misappropriate any trademark, copyright, trade dress, right of publicity, privacy or other right of any person, and is not defamatory or unlawful; and
you will provide proof of your rights (such as a licence agreement) on request, and we may refuse or delay any order until you do.
You are solely responsible for Your Content and for any mockups, documents and products created from it, including anything you show to or produce for your own clients.
6. Prohibited uses
You must not use the Service to:
create mockups or products using trademarks, logos, team or league marks, characters, artwork or names of others without their permission, including counterfeit or “inspired by” knock-offs;
upload hateful, harassing, obscene, violent, or otherwise unlawful material, or content that exploits minors;
misrepresent a mockup as an official product of a brand, or remove or obscure ownership notices;
copy, scrape, resell, sublicense, or build a competing product from the Service, its hat images, masks or rendering, or bypass paywalls, watermarks or licence checks;
reverse engineer the Service except where the law allows it; overload, probe or disrupt it; or upload malware.
7. Brand screening & removal
To help prevent misuse, the Service may automatically screen artwork and text for well-known brand names and logos. When enabled, a reduced copy of an uploaded image may be sent to a third-party image-recognition service for this check; it is not stored by us. Screening is a safety net, not a legal review: it can miss protected material and can flag permitted material. A screening result never confirms that you have the right to use something. We may warn you, require confirmation of your rights, block artwork, remove content, refuse or cancel orders, or suspend accounts at our discretion.
8. Infringement reports
We respect intellectual property. If you believe content on or produced through the Service infringes your rights, send a notice to michael@decoratorsunited.com (mailing address: Spokane, WA) including: your contact details; a description of the work or mark; where the material appears or the order involved; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature. We will act on valid notices, may remove material and notify the user, and will terminate repeat infringers in appropriate circumstances. Counter-notices may be sent to the same address.
9. Mockups & quotes
Mockups, measurements, stitch counts and colors are visual approximations for planning and approval. Actual products may differ in size, placement, color and texture due to materials and production. A quote request is not an order and creates no obligation for either party. Prices are provided only in a quote from us, which is valid for the period stated in it. Any order you place is governed by the quote, proof approval and order terms we provide at that time.
10. Our property & third-party marks
The Service, including its software, design, hat images, masks, rendering, templates and documents (excluding Your Content), is owned by us or our licensors and protected by law. Your subscription gives you a limited, revocable, non-transferable right to use the Service and to use exports you create for your own and your clients’ business purposes, subject to these Terms.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that mockups will match finished products, that brand screening will detect all protected material, or that any content is lawful to use.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business, arising from or related to the Service, even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars (US$100).
Some jurisdictions do not allow certain exclusions; in those places our liability is limited to the extent permitted by law.
13. Indemnification
You will defend, indemnify and hold harmless Decorators United, its owners, employees and contractors from and against any claims, demands, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from or related to Your Content, your breach of these Terms or of the rights you confirm in section 5, mockups, documents or products created from Your Content, or your use of the Service, including any claim that Your Content infringes a trademark, copyright or other right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access, deactivate licence keys, and remove content immediately if you breach these Terms, create legal risk, or fail to pay, without refund where permitted by law. Sections 4 to 6 and 8 to 16 survive termination.
15. Governing law & disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to their jurisdiction. Either party may bring a claim in small-claims court where eligible. You agree to bring claims only on an individual basis, not as part of a class or representative action.
16. General
We may update these Terms; material changes will be shown in the Service, and continued use after they take effect means you accept them. These Terms and any order or quote terms are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business.
